Sexual Harassment Prevention Plan
In December 2022 a new positive duty was introduced under the Sex Discrimination Act 1984 (Cth) by the Australian Human Rights Commission. Positive duty was a key recommendation of the Commission’s landmark Respect@Work Report.
From 1st March 2025, all businesses—regardless of size—must implement a Sexual Harassment Prevention Plan to comply with amendments to the Work Health and Safety Regulation 2011. This applies to all Persons Conducting a Business or Undertaking (PCBU) and requires proactive steps to manage risks related to sexual harassment and sex or gender-based harassment in the workplace.
